New Policies Expand Housing Options on Single-Family Parcels & Allow RV Residences

A new state now allows single-family homeowners to add additional housing to their property or split their property with new housing. A new Oakland law now allows for RVs and tiny homes on wheels to be lived in with special permits.

California Housing Opportunity and More Efficiency (HOME) Act, Senate Bill 9 (SB-9)

The California Housing Opportunity and More Efficiency (HOME) Act, Senate Bill 9 (SB-9) requires the City to create a ministerial approval process for single-family residential zoned lots to 1) approve two residential units on a single-family lot and/or 2) subdivide a single-family parcel into two separate lots, enabling the creation of either a single-family home or two residential units on each resulting parcel.

SB-9 is intended to increase residential housing stock and incentivize the building of affordable housing units. For more information about how SB-9 is applied in the City of Oakland and instructions to apply, please visit our webpage.

Oakland Construction Innovation and Expanded Housing Options Ordinance Goes Into Effect Jan. 15

On November 16, 2021, the Oakland City Council unanimously passed the Oakland Construction Innovation and Expanded Housing Options Ordinance to increase housing options and affordability for all Oaklanders. The Ordinance goes into effect on Saturday, January 15, 2022.

The Ordinance updated the City's zoning regulations to:

  • Allow residential occupancy of recreational vehicles (RVs) and tiny homes on wheels ("Vehicular Residential Facilities") on private property subject to certain health and safety standards;
  • Allow mobile homes and manufactured homes in all zoning districts where residential uses are permitted;
  • Establish density and open space regulations for efficiency dwelling units; and
  • Establish height regulations for modular construction.
  • In addition, the Ordinance amended the Oakland Building Code to allow light straw-clay construction.
