How will my Flex Streets Sidewalk and Parking Lane Application be Approved

Use of the Sidewalk

If you apply to install a café or merchandise display, on the sidewalk, your application is deemed Approved upon submission to OakDOT of a complete application package, if items a) thru e), below, are all true.

You may install your café or display. Do not block any part of the single, straight, minimum 6-foot wide, Clear Pedestrian Path. You will receive your permit within 30 days.

a. Socially distanced tables and chairs or merchandise will be placed within:

  • Frontage Area: the first two feet of public space in front of a business, or
  • Café Area: extending from the property line to the café line [i.e. the edge of the clear pedestrian path]. Maximum of 1/3 of the total sidewalk for merchandise display

b. No permanent structures will be built, and no items will be drilled or bolted to the pavement

c. The merchandise or café will be installed directly in front of the business, or you have submitted written consent from your neighbor(s) as part of your application

d. The café or display area is accessible, and other relevant ADA guidelines have been applied

e. Any hanging or overhead objects, including umbrellas or canopies, have a clearance of at least 7 feet (84 inches) from the ground

Use of the Parking Lane

If you apply to install a café in the parking lane [aka, a “parklet”], your application is deemed Approved upon submission to OakDOT of a complete application package, if items a) thru e), below, are all true.

You may install your café, including ADA ramp access from the sidewalk to the seating area. You will receive your permit within 30 days.

a. The parklet location is a legal parking spot(s) at the curb

b. You have requested no more than two parking spots

c. The parklet is at least one parking spot [or 25 feet] away from the intersection or stop line

d. The parklet will be located directly in front your business, or you have submitted written consent from your neighbor(s) as part of your application.

e. Wheel stops and reflective pylons are installed at either end of the parklet, and durable planters or barriers, 30 to 36 inches in height, provide protection on the traffic side of the parklet
